1. Who we are

These Terms are between you and Neighborhood Swing LLC, an Ohio limited liability company ("Neighborhood Swing," "we," "us"), which operates an indoor golf simulator facility at 4774 Mahoning Avenue, STE 2, Austintown, OH 44515 (the "Facility"). "You" means the person who makes a booking, buys a membership, enters the Facility or uses its equipment.

2. Eligibility and minors

• You must be at least 18 years old to create an account, make a booking or buy a membership.
• Anyone under 18 must be accompanied and supervised by a parent, legal guardian or responsible adult (18 or older) at all times while in the Facility.
• If you bring a minor, you confirm that you are the minor's parent or legal guardian, or that you have the parent's or guardian's permission. You agree to these Terms on the minor's behalf, you are responsible for the minor's conduct and safety, and you agree to the Assumption of Risk, Release and Indemnification sections for the minor to the fullest extent permitted by law.

3. Your guests

• Each booking covers up to 5 people: you plus up to 4 guests.
• You are responsible for every guest you bring. Before your guests enter, you agree to tell them about these Terms and the facility rules, and you confirm that each adult guest agrees to them. We may ask guests to accept these Terms directly.
• You are responsible for any damage, rule violation or claim caused by your guests, and you agree to indemnify Neighborhood Swing for it (see Section 6).

4. Assumption of risk

Golf, including golf on a simulator, is a physical activity with inherent risks that cannot be removed without changing the nature of the activity. These risks include, but are not limited to:

• Being struck by a golf club, a golf ball, or a ball that rebounds or ricochets off the screen, enclosure, walls, floor, ceiling, equipment or other surfaces.
• Muscle strains, sprains, back, shoulder, wrist, elbow and joint injuries, and injuries from swinging, twisting or overexertion.
• Slips, trips and falls, including on hitting mats, turf, flooring, steps, cords and edges.
• Injuries from equipment, furniture, fixtures, the enclosure, screens, projectors, lighting, launch monitors or computers.
• Eye strain, headaches, dizziness or seizures from screens, projected images or lighting.
• Exposure to illness from other people or shared surfaces and equipment.
• Injuries caused by the actions of other people in the bay, including your guests.
• The fact that the Facility is unstaffed, so no employee may be present to supervise, give instruction, or provide immediate help or first aid.

You understand these risks, you choose to participate voluntarily, and you knowingly assume all risks of injury, illness, death and property damage, whether known or unknown, for yourself, your guests and any minor you bring.

5. Release of liability and waiver of claims

6. Indemnification

You agree to defend, indemnify and hold harmless the Released Parties from any claims, lawsuits, losses, damages, costs and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Facility, (b) the conduct of your guests or any minor you bring, (c) your breach of these Terms, or (d) any claim brought by your guest or a minor you bring, to the fullest extent permitted by law.

7. Health and fitness

• You confirm that you, your guests and any minor you bring are in good enough health to swing a golf club and take part safely. If you have a medical condition, injury or pregnancy, or if you are unsure, check with your doctor before playing.
• Stop playing immediately if you feel pain, dizziness, shortness of breath or any other symptom.
• Do not enter or play under the influence of alcohol, drugs or any substance that impairs your judgment or coordination.

8. Unstaffed facility and access

• The Facility is open 24/7 and is not staffed. You will receive a door code by text before your booking. Help is available by text or call at (330) 885-2484, but no one may be on site.
• Your door code is personal. Do not share it with anyone outside your group, and do not let anyone in who is not part of your booking. Make sure the front door closes and locks behind you when you enter and leave.
• Enter only at your booked time and leave when your booking ends, so the next golfer can start on time. Staying past your booking without booking more time may result in an additional charge at the current hourly rate.
• Use only your booked bay and the common areas. Equipment cabinets, computers, network equipment, utility areas and back rooms are off limits.

9. Facility rules

1. Safety first. Only one person in the hitting area at a time. Everyone else must stay behind the black line unless hitting. Check that no one is nearby before every swing.
2. Hit only from the hitting mat, toward the center of the screen, with clean golf balls and clubs in good condition. No range balls, dirty or damaged balls, practice or foam balls, or cracked or loose clubs. Inspect borrowed clubs before using them.
3. No metal spikes. Wear clean, appropriate footwear.
4. No alcohol, smoking, vaping, illegal drugs or weapons anywhere in the Facility.
5. Food and non-alcoholic drinks are welcome. Keep drinks away from the hitting area, computers and equipment.
6. Do not change, unplug, move, adjust or tamper with any equipment, settings, software, cameras, cables, projectors or launch monitors.
7. Children must be supervised at all times and may not play unsupervised or stand in the hitting area unless hitting.
8. No pets, except service animals.
9. Respect the space. Clean up after your group, put clubs and furniture back, throw away trash and leave the bay ready for the next golfer.
10. Respect other customers and neighbors. No disruptive, unsafe, abusive or illegal behavior.
11. Report any damage, malfunction, spill or safety hazard right away by text or call to (330) 885-2484.

10. Damage to property

• Normal wear from ordinary golf play is expected. You are responsible for any damage to the Facility, the impact screen, enclosure, projector, launch monitor, computers, TVs, furniture, clubs, building or other property caused by you, your guests or a minor you bring through misuse, negligence, horseplay, breaking the rules or intentional acts.
• You authorize Neighborhood Swing to charge the payment method on your account for the reasonable cost to repair or replace damaged property, plus any cleaning fee for excessive mess, after giving you notice and a description of the damage. Camera footage may be used to determine responsibility.

11. Personal belongings

You are responsible for your personal property, including clubs, bags, phones and valuables. Neighborhood Swing is not responsible for lost, stolen or damaged personal property. Items left behind may be held for 30 days and then donated or discarded.

12. Cameras and recording

For safety and security, the Facility, including each bay, entrance and common area, is monitored by video cameras 24 hours a day. There is no audio recording. By entering, you consent to being recorded. Footage may be used to protect the Facility and customers, verify league scores, investigate damage or incidents, and cooperate with law enforcement and insurers. We do not post security footage publicly.

13. Bookings, payment and refunds

• Bookings are made and paid for online through our booking system. Prices are shown at checkout and may change at any time; your price is locked in once you book.
• Cancellations and changes follow the policy shown at checkout in our booking system.
• Our guarantee: if your session is not the best hour of indoor golf you've ever had, text us at (330) 885-2484 within 24 hours of your booking and we will refund that booking. The guarantee applies to hourly bookings, not to memberships, leagues or gift cards, and we may decline repeated or abusive requests.
• No refunds are given for time missed because of a late arrival, early departure, or removal for breaking these Terms. If equipment fails during your session and we cannot fix it remotely, we will offer a credit or refund for the time lost.

14. Memberships, leagues and gift cards

• Memberships are subject to the plan terms shown at purchase, including billing, the first-month guarantee, prepaid terms and booking limits. Membership access is personal and may not be shared.
• Leagues are subject to the league rules posted on our website and in Golf Genius, including fair-play rules and score verification. League rulings by Neighborhood Swing are final.
• Gift cards are not redeemable for cash except where required by law, and lost or stolen cards are not replaced unless we can verify the card number and balance.

15. Emergencies

• In an emergency, call 911 first. Then text or call us at (330) 885-2484. The Facility address is 4774 Mahoning Avenue, STE 2, Austintown, OH 44515.
• Know where the exits are. Do not block exits, walkways or exit signs.
• You authorize emergency medical treatment for yourself and any minor you bring if you or they are unable to consent, and you are responsible for the cost of that treatment.
• Report any injury to us within 24 hours, even if it seems minor.

16. Removal and suspension

We may cancel a booking, end a session, deactivate a door code, or suspend or terminate an account or membership without refund if you or your guests break these Terms, behave unsafely, damage property, share access, or act in a way that we reasonably believe puts people or property at risk. We may also contact law enforcement when appropriate.

17. Texts, email and privacy

By booking, you agree to receive texts and emails about your booking, including your door code, reminders and account notices. Message and data rates may apply. Marketing messages are sent only if you opted in, and you can reply STOP at any time. Our Privacy Policy explains how we collect and use your information.

18. Photos and social media

We may take photos or video of the Facility for marketing, but we will not post photos or video of identifiable customers without their permission. League winners may be featured on our social media; tell us if you'd prefer not to be.

19. Governing law and general terms

• These Terms are governed by the laws of the State of Ohio. Any dispute will be brought only in the state or federal courts located in Mahoning County, Ohio, and you consent to their jurisdiction.
• You agree that these Terms are as broad and inclusive as permitted by Ohio law. If any part is held invalid or unenforceable, the rest stays in full force, and the invalid part will be enforced to the maximum extent allowed.
• These Terms, together with any plan, league or gift card terms shown at purchase and our Privacy Policy, are the entire agreement between you and Neighborhood Swing about your use of the Facility.
• We may update these Terms from time to time. The effective date at the top shows the latest version, and the version in effect when you book or enter applies to that visit.
• Accepting these Terms electronically, including by checking a box or completing a booking, has the same effect as signing them on paper.
